These Terms of Service govern the purchase and use of BoomNodes software ("the Software"), provided by André Weiers, Stresemannstraße 86, 22769 Hamburg, Germany ("the Seller"). By purchasing or using the Software, you agree to these terms.
Upon purchase, you receive a non-exclusive, non-transferable, perpetual license to install and use the Software on your own devices for personal or professional purposes. The Free tier is available without payment under the same conditions, limited to 10 maps.
You may not:
The Software is currently in beta. Features may change, be added, or removed. Beta access is provided free of charge. The Seller makes no guarantees regarding stability, feature completeness, or data persistence during the beta phase.
Pro license holders receive all future updates to the Software at no additional cost, as long as the Software is actively maintained by the Seller.
All intellectual property rights in the Software remain with the Seller. These Terms do not transfer any ownership rights to you.
The Software is provided “as is” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Seller does not warrant that the Software will be error-free or uninterrupted.
To the fullest extent permitted by applicable law, the Seller shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Software, even if advised of the possibility of such damages. The Seller’s total liability shall not exceed the amount paid for the Software.
These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Hamburg, Germany, to the extent permitted by applicable law.
